By making use of this service, you are indicating ownership of the equipment to be serviced or that you have the owner's permission to have the service performed. You agree to pay in full all charges associated with the labor and parts related to work performed by Cermak Technologies, Inc. and its associates. Currently, regular remote technical support is charged at the rate of $65 per hour. A service charge of 1.5% per month, 18% APR, will be added to all overdue invoices. You are responsible for all legal and collection fees. Charges are subject to change without notice.
It is the responsibility of the client to maintain recent backups of all data. Cermak Technologies, Inc. and its associates are not responsible for lost data. Please check your backups regularly.
In no event shall we be liable for any special, direct, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, whether in an action of contract, negligence, or other action, arising out of or in connection with our services or equipment. Should Cermak Technologies, Inc. be found liable for any loss or damage, then the liability shall be limited to the sum equal to the amount of the fee paid for those services.
Systems, parts, data, accessories, and all other belongings at our location, whether after drop-off or pick-up, that remain for more than 30 days become property of Cermak Technologies, Inc. Items not picked up before that time will be disposed of as we see fit. By leaving items for more than 30 days, the client forfeits all rights to any property and will not be reimbursed.
This agreement sets forth the entire understanding and agreement of the parties and supersedes all prior or verbal agreements, promises, or arrangements related to this matter. It may only be changed by a written agreement signed by both parties. This agreement shall be governed by and construed according to the laws of the Commonwealth of Pennsylvania. In the event any litigation would arise from this agreement, the parties agree that same shall be submitted to binding arbitration. You may make a copy of these terms for your records.
